Disability Criteria

SARS Compliance

SARS defines disability as a moderate to severe limitation in daily activities, including mental, sensory, physical, or communication impairments. Disability status is determined by the impact on activities like walking, speaking, and memory.

  • The condition must be permanent, likely to last over a year, and verified by a healthcare practitioner using SARS documentation (ITR-DD form).
  • Must be a Tax payer or dependent on a Tax payer (Spouse or qualifying child).
  • Must have a Disability confirmed by an authorised Medical practitioner.
  • Must have medical expenses and/or disability related expenses.
Overcoming challenges with Phoenix Disability Tax
  • Physical: Conditions that impact mobility or physical appearance (e.g., amputees, spinal-cord injuries, cerebral palsy).
  • Mental: Diagnosed by a mental health practitioner indicating impairment impacting daily functioning like learning and communication.
  • Visual: Visual acuity in the better eye of less than 6/18.
  • Hearing: Impairment affecting verbal communication.
  • Intellectual: Moderate to severe impairment in intellectual functioning.

Frequently Asked Questions

Everything you need to know before starting your claim

Who qualifies for a SARS disability tax rebate?
Anyone who is a registered taxpayer (or a dependent of one) with a permanent disability — physical, mental, visual, hearing, or intellectual — that has been confirmed by an authorised medical practitioner using the SARS ITR-DD form. The condition must be moderate to severe and likely to last more than a year.
What is the ITR-DD form?
The ITR-DD is the official SARS Confirmation of Diagnosis of Disability form. It must be completed by a registered medical practitioner and is required to claim the additional medical expenses tax credit. Getting this form completed correctly is critical — even small errors can lead to rejection.
How far back can I claim?
SARS generally allows claims to be submitted or amended for the past three tax years, depending on your specific situation. Contact us to assess your individual case — many of our clients are surprised by how much they can recover.
Does mental health (ADHD, Bipolar, Depression) qualify?
Yes — mental health conditions including Bipolar Disorder, ADHD, Major Depression and others can qualify if diagnosed by a registered mental health practitioner and they meet SARS's criteria for moderate to severe limitation of daily functioning. This is one of our most common claim categories.
How long does the claim process take?
Once we have your complete documentation, we move quickly. SARS processing times vary, but we ensure your submission is audit-ready from day one — which significantly reduces back-and-forth and speeds up payouts.
What if SARS audits or rejects my claim?
We prepare every claim to withstand the most discerning SARS audits — that's the difference between us and a generic tax service. If you're already facing a rejection or audit, we can help review your case and respond appropriately.
